This Terms of Service & Refund Policy applies to all services purchased from Evotech Digital Pty Ltd (“Evotech Digital”, “we”, “us”) via evotech.au, including the $199 AI Agent & Website Proof of Concept (“POC”) and any ongoing monthly subscription plan. By placing an order, you agree to the terms below.
Our services
Evotech Digital designs and builds custom AI Agents and supporting websites. Our core offer is a fixed-scope, fixed-price Proof of Concept ($199) delivered within the timeframe stated on our Site (currently 10 business days from receipt of your onboarding details), followed by an optional ongoing subscription (from $39/month) covering hosting, maintenance, and support.
Proof of Concept ($199) — refund eligibility
Because the POC involves custom development work that begins shortly after checkout, refund eligibility depends on how far your project has progressed:
- Before onboarding is submitted: full refund available on request — no build work has started.
- After onboarding, before build starts: full refund available within 24 hours of purchase.
- After build has started: refunds are assessed case by case. If we are unable to deliver a working Proof of Concept that reasonably matches your submitted requirements, you are entitled to a full or partial refund.
- After delivery: the POC is provided as-is for evaluation purposes. If the delivered POC does not function as described, contact us within 7 days of delivery for a fix or refund.

Subscription plans
- Billing: subscriptions are billed monthly in advance from the plan start date.
- Cancellation: you may cancel at any time from your My Account dashboard or by emailing us. Cancellation takes effect at the end of the current billing period — we do not provide partial-month refunds for cancellations.
- Changes to inclusions: if we materially reduce what is included in your plan, we will notify you and you may cancel without penalty.
- Non-payment: we may suspend hosting or support if a subscription payment fails and is not resolved within 7 days of notice.
Your rights under Australian Consumer Law
Nothing in this policy limits or excludes any consumer guarantee, right, or remedy that you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the ACL, including the right to a refund for a major failure and compensation for other reasonably foreseeable loss or damage.
How refunds are processed
Approved refunds are returned to your original payment method via WooCommerce Payments, typically within 5–10 business days. We will notify you by email once a refund has been processed.
Chargebacks
If you believe a charge was made in error, please contact us first so we can resolve it directly — this is faster than a bank chargeback and avoids additional processing fees. Unwarranted chargebacks may result in suspension of your account and services.
Changes to this policy
We may update this policy from time to time. The “Last updated” date above reflects the latest revision. Continued use of our services after a change constitutes acceptance of the updated policy.
